A grand jury will investigate the death of a 54-year-old Yutan woman found unresponsive in her cell at the Saunders County jail in Wahoo.

Jail staff found Kelly Berney-Garcia in her cell late Sunday night and attempted emergency measures before Berney-Garcia was taken to Saunders County Medical Center, just outside of town, Sheriff Kevin Stukenholtz said in a news release.

An autopsy will be conducted, and the Nebraska State Patrol is investigating, the release said.

Berney-Garcia had been at the jail since Dec. 14, serving a 10-day sentence as part of her probation, according to court records. She was convicted of child abuse and assault in 2016.

Nebraska law requires a grand jury to investigate any death occurring while a person is in jail or in law enforcement custody.
